Religious Rights Lawsuit Spawns Follow-up Suit for ACE Unit

June 24th, 2014 - After Maui County, Hawaii, was sued in federal court for allegedly violating the first amendment rights of a preacher handing out religious tracts, the government body turned to ACE American Insurance Co. seeking defense and indemnity.

Now, Maui County has sued the ACE unit over its reported refusal to defend it in that lawsuit.

Famed Resort Sues ACE Over “Derecho” Damages

May 13th, 2014 - The Greenbrier Hotel in West Virginia has sued ACE American Insurance Co. and six other insurers in a loss of business claim stemming from one of the nation’s deadliest wind storms.

Greenbrier Hotel Corp. and The Greenbrier Sporting Club Inc. sued the ACE unit and other insurers that include The Underwriters at Lloyd’s of London in West Virginia State Court. The defendants have since petitioned to remove the matter to U.S. District Court in West Virginia.

Superstorm Sandy Lawsuit Filed Against Bankers Standard Insurance Company

April 28th, 2014 - Was it wind, or water? Owners of a New Jersey Shore home have sued Bankers Standard Insurance Co. after it denied their repairs claim stemming from 2012’s Superstorm Sandy.

Joseph Zawadsky, Marilyn Zawadsky and Carol Martinez, trustees for a trust that owns the Mantoloking, N.J. home in question, had purchased insurance on the oceanside property effective June 15, 2012. They had coverage from the ACE Group unit for both property damage and loss of personal property.

Judge Orders Illinois Union to Pay $11.3 Million on Legal Defense Spat

Illinois Union Insurance Co. was ordered in February of 2012 to defend a former client being sued over environmental pollution claims. The question of indemnity for costs the client already had incurred was left open – until now.

Federal Judge James J. Brady, in Baton Rouge, Louisiana, has ruled that the ACE Group unit must pay $11.3 million in legal defense fees to Louisiana Generating LLC. It is owned by Houston-based NRG Energy Inc. and operates the Big Cajun II electric power plant in New Roads, Louisiana.

ACE Group Pays Fine in California Regulatory Settlement

April 7th, 2014 - ACE Group has agreed to pay $100,000 to resolve a complaint by California Insurance regulators that claim it was out of compliance with state rules.

The insurer did not admit any wrongdoing but agreed to the penalty as part of a deal to end issues discovered in a market conduct exam begun in late 2008.

Rusty Machine Leads to Lawsuit Against ACE Group Insurer

January 17th, 2014 - A plastics recycler has taken Westchester Fire Insurance Co. to court after it received processing equipment that allegedly was damaged in transit.

Plastic Recyclers Southeast Inc., of Decatur, Ala. bought a machine called a granulator in 2013 from a supplier based in suburban Chicago. The machine was intended to be used at a company plant at Menomonie, Wisconsin.

Asbestos Victim Sues ACE Unit to Force Collection of Damages

March 10, 2014 - A Louisiana woman who was awarded more than $6 million in her suit over asbestos exposure has now sued the defendants’ insurers in an effort to collect the judgment.

Insurance Company of North America was one of eight defendants named in the lawsuit filed in U.S. District Court in the Eastern District of Louisiana on behalf of Mary Morvant. According to the complaint, Insurance Company of North America (INA), a unit of ACE Group, had sold liability coverage to Asbestos Corporation Limited from July 1st, 1978, to July 1st, 1981.

Client Sues ACE Unit Over Stalled, then Denied, Claim

March 3rd, 2014 - A Michigan limited liability company has sued ACE American Insurance Co. claiming it dragged out payment on a theft loss claim for nearly two years and then refused to make payment.

AMI Stamping Co., the ACE customer, had acquired a Detroit gear manufacturer in 2010. Along with that came property and equipment owned by the acquired company.

In January 2012, AMI said that it was given notice that the Detroit facility had been burgled and equipment was stolen. AMI said it notified both the Detroit Police and ACE.

February 11th, 2014 - Westchester Surplus Lines Insurance Co. has sued a Florida repair service that worked on a hotel room air conditioning unit that later caught fire and damaged the property it insured.

Ace Group Unit Sues Shipper over Spoiled Chocolates

January 27th, 2014 - Indemnity Insurance Co. of North American (IINA) has sued an ocean cargo liner after a load of chocolates shipped to a client in the United States allegedly arrived in poor condition.
