Carpenter, Boss Sue ACE Over Workplace Lawsuit

December 9th, 2014 - A disabled carpenter and his former employer have sued ACE Insurance Group Inc. in an effort to get the insurer to provide defense and coverage for a lawsuit involving his career-ending workplace injuries.

Ivan Holle was working in 2007 for Select Build of Illinois LLC on a residential carpentry project that was subcontracted to Realen Homes LP. On May 30th, 2007, a wall fell on Holle, injuring his neck, back and shoulder and ending his career as a carpenter.

Trucker Loses Finger, Sues ACE Over Refusal to Pay Damages

October 15th, 2014 - A California truck driver has sued ACE American Insurance Co. after it allegedly refused to compensate him for the loss of his pinky finger while at work.

Manuel Zatarain Sr., of suburban Los Angeles, is a truck driver who had purchased an occupational accident plan policy from the ACE Group unit. That policy was in force on June 26th, 2010, when Zatarain delivered a load of bottled water to a Target store in Orange, California. At the time, he was operating a truck as an independent driver for Ceva Logistics.

Roof Damage Wrangle Blows into Suit Against ACE Unit

October 6th, 2014 - A Texas homeowner has sued Bankers Standard Insurance Co. after it allegedly offered her 1/200th of the money she believes is due to her for insured wind and hail damages.

Karen Misko said she had purchased a “platinum portfolio” homeowners’ policy from the ACE Group unit that took effect for a one-year period beginning May 21st, 2012.

After String of Heists, Truckline Sues ACE Unit over “Delay Tactics”

September 29th, 2014 - A California trucking firm has sued Westchester Surplus Lines Insurance Co. over its alleged failure to properly investigate and then pay it for two claims related to thefts from a truck and a warehouse.

Amerifreight Inc. accused the ACE Group unit in a suit filed in U.S. District Court for the Central District of California of employing what it called delay tactics in paying the claims. It said Westchester Surplus had breached its duty to bargain in good faith.

A Texas auto dealer claims an erroneous change to a renewed liability policy from ACE American Insurance Co. left it open to a half million dollar judgment in a separate auto collision lawsuit.

Power Company Sues ACE Over California Wildfire Damages

September 3rd, 2014 - Legal fallout from one of the worst series of wildfires to ever strike California has continued for ACE American Insurance Co. with a lawsuit being filed against it by a leading state utility.

Southern California Edison Co. contends in a federal suit filed in U.S. District Court in Los Angeles that the ACE unit has repeatedly ignored its request to defend or indemnify the utility. Also named in the suit were ESIS Inc., another ACE unit that handles claims for it, and Time Warner Cable Enterprises LLC.

Boat Owners Sue ACE Over Denied Damage Claim

August 4, 2014 - Owners of a motorboat that caught fire have sued ACE American Insurance Co. after it allegedly refused to reimburse them for damages caused by the blaze.

Robert and Susan DiLoreto had purchased a boat insurance policy issued by ACE and sold by a Grosse Pointe Woods, Michigan agency to cover two boats that they owned. One was a 31-foot Boston Whaler Cruiser named Peterbilt that they took out of winter storage on June 15th, 2013.

Longtime Employee Sues ACE Unit Over Terrorist Claim

July 28th, 2014 - A former territory manager for Combined Insurance Co. has sued the ACE Group unit over charges that he was fired in retaliation for complaining that he had been publicly called a foreign-born terrorist.

Jamshid “Jim” Pedram is a first-generation immigrant from Iran who went to work for Combined in 1985 as an insurance agent at its Kansas City, Missouri office. He said he received positive reviews for his work and in 2009 was recognized by the company for sales performance.

Insurer Sues ACE Unit Over Brewery Worker Death

July 28th, 2014 - When Anheuser Busch Inc. was sued by the estate of a woman whose late husband had once worked for the brewer, Zurich American Insurance Co. paid for the company’s entire defense. It also later paid that estate a confidential settlement over a claim that the husband contracted mesothelioma at the work site.

And now Zurich American wants Insurance Co. of North America to contribute to the defense and settlement expenses, because it co-insured Anheuser Busch.

11-year-old Legal Feud Starts New Chapter with Lawsuit Against ACE Unit

June 24th, 2014 - The operator of an airport fuel service in Montana has sued ACE Property and Casualty Co. for allegedly refusing to defend a client in a long-running courtroom battle.

John Talmage, of Kalispell, Montana, owns Montana Diamond Aire Inc. and RJT Properties LLC. Diamond Aire sells fuel at Kalispell Municipal Airport and sells airplane modification kits and parts, while RJT owns the property from which Diamond Aire operates.
