"COUNT I - NEGLIGENCE
16. The fire and resulting damages were proximately caused by the negligent acts and omissions of defendants Ryan Parker and Steve Moroney, including but not exclusively in the following ways:
a) failing to properly cook;
b) leaving a pan or pot of grease on the stove cooking while unattended;
c) failing to take the appropriate and safe measures while cooking;
d) otherwise acting negligently as will be disclosed during the discovery process.

17. The foregoing negligent acts and omissions of defendants Ryan Parker and Steve Moroney proximately caused the fire and resulting damages.

WHEREFORE, plaintiff demands judgment against defendant Ryan Parker and Steve Moroney in an amount in excess of the jurisdictional limits of this court.

COUNT II - BREACH OF CONTRACT

18. The fire and resulting damages were proximately eaused by the breach of contract of Adrienne Parker.

19. As co-signer on the lease. Adrienne Parker agreed, contracted and warranted that she would be responsible for any damages eaused by her son. Ryan Parker, and would maintain the property in a good condition.

20. Plaintiff has made demand on Adrienne Parker that she honor the terms of the lease.

21. Adrienne Parker breached the lease agreement by failing to repair the damage to the apartment and failure to be responsible for the damages suffered by plaintiff as a result of the fire.

WHEREFORE, plaintiff demands judgment against defendant Adrienne Parker in an amount in excess of the jurisdictional limits of this Court."
