COMES NOW the Plaintiff, Lee E. Steinman, and for cause of action against the
Defendant, Ace American Insurance Company, states as follows:
1. Plaintiff Lee E. Steinman at all relevant times herein resided at 39 N.
Caseville Road, Pigeon, Michigan.
2. Defendant Ace American Insurance Company (“A ce”) is a corporation
organized and existing under the laws of Pennsylvania and authorized to do business in
the state of Michigan.
3. On October 3, 2012, Plaintiff was apassenger in a vehicle driven by his
wife, Sherri! L. Steinman, and was traveling eastbound on Richardson Road in Huron
County, Michigan. On the same date, and at the same approximate time of the collision
further described herein at approximately 2:33 p.m., a vehicle driven by Luis M.
Gutierrez (“Gutierrez”) was traveling southbound on Krohn Road in Huron County,
Michigan.
4. ■ Gutierrez at the time of the accident in question was employ ed by General
Electric Co. and driving a vehicle owned by Hertz Equipment Rental Corporation.
5. Gutierrez’ automobile failed to yield the right-of-way and failed to stop at a
stop sign and struck the Steinman vehicle in which Plaintiff was a passenger causing
serious impairments o f bodily function to Plaintiff and severe injuries to Plaintiffs wife,
Sherril L. Steimnan. The injuries suffered in this accident by Plaintiff Lee E. Steinman
were a serious impairment of a bodily function.
6. Plaintiff incurred reasonable and necessary medical expenses, replacement
services, and loss o f income benefits as a result o f this automobile accident.
7. Sherril L. Steinman’s 2010 Cadillac being driven by her at the time of the
accident in question was insured by Defendant Ace American Insurance Company,
H08634294.
8. Ace has refused to pay reasonable and necessary medical expenses and
replacement services of Plaintiff. Ace has refused to pay any of the statutory three-year
loss of income benefits to Plaintiff, which Plaintiff is entitled to under both Iris wife’s
insurance policy with Ace and MCL § 500.3101 et. seq.
9. Ace has unreasonably and untimely failed to pay said benefits referenced
earlier herein to Plaintiff.
WHEREFOE, Plaintiff Lee E. Steinman prays for judgment against Defendant,
Ace American Insurance Company, for reasonable and necessary medical expenses,
replacement services, as well as loss o f income benefits, attorney fees, costs and such
other relief as the Court deems just and equitable in the premises, all as provided by
Michigan statute as will be shown by competent proof at trial.
JURY DEMAND
COMES NOW the Plaintiff, Lee E. Steinman, and hereby demands trial by jury
in this matter on all issues raised in this Complaint.
