"16. St. Paul contends that ACE had a duty to defend ARB with respect to the West Maui Action. St. Paul also contends that ACE had a duty to indemnify ARB with respect to the settlement in the West Maui Action.
21. ACE has not reimbursed st. Paul for the defense fees and costs St. Paul had incurred in providing a defense to ARB in the West Maui Action.
22. In addition, St. Paul contributed toward the settlement paid on behalf of ARB to settle the West Maui Action. Despite S1. Paul's demand to participate, ACE failed to pay any portion of the settlement in the West Maui Action.
23. St. Paul is entitled to reimbursement and contribution from ACE in an amount to be proven at trial plus interest."
