against it by Lori Ann Palumbo on the eve of trial, based upon a misguided notion that Main Street had knowledge of a pre-existing claim.
20. Upon information and belie£: ACE breached their agreements with Main Street by failing to fully investigate whether Main Street had the requisite knowledge of a claim that ultimately was brought by Palumbo.
21. Upon information and belief, ACE breached their agreements with Main Street by narrowly interpreting the exclusion based upon pre-existing knowledge of a claim in contravention of what is normally expected by an insured in New Jersey, withdrawing its defense on the eve of trial.
22. Main Street has been damaged by the actions of the defendants in an amount to be determined."
