"The subpoena issued by Westchester Fire Insurance Company and ACE INA Holding, Inc. (collectively, "Defendants") to Edward W. Butner, IV (the "Subpoena"), is wholly improper and should be quashed.  In addition, this Court should enter a Protective Order prohibiting the disclosure of any proprietary and/ or confidential information (including financial information) pertaining to Credit General Insurance Company and Credit General Indemnity Company (collectively, "Credit General"). Neither the Liquidator nor Credit General nor Mr. Buttner is a party to the proceeding from which the Subpoena emanated and Credit General's financial condition and information are irrelevant to that matter.  Nor is Mr. Buttner a retained expert witness  in that case. "
