"I.Made defendants herein are the following parties:
A. Ray Williams, a person of the full age of majority, domiciled in the County of Dallas, State of Texas;
B. USA Truck Inc., LLC, a corporation licensed to do and doing business in the Parish of West Baton Rouge, State of Louisiana;
C. PV Holding Corp., a corporation licensed to do and doing business in the Parish of West Baton Rouge, State of Louisiana; and
D. Ace American Insurance, a licensed insurer licensed to do and doing business in the Parish of Orleans, State of Louisiana.

Defendants are liable unto your petitioners, jointly, severally, and in solido, for
reasonable damages, for the following to wit:

On or about the 29th day of October, 2011 at approximately 3:40 p.m., petitioner herein,Devon Harvey, was operating a rental vehicle, a 2011 Volkswagen Jetta, owned by PV Holding Corp. westbound on the 1-10 westbound exit ramp at LA 415, where he had stopped behind defendant herein, Ray Williams, also traveling westbound on the 1-10 westbound exit ramp at LA 415, who was operating with permission, a 2009 Kentworth Tractor, owned by USA Truck Inc., LLC, when Mr, Williams backed his vehicle into Mr. Harvey's vehicle.

The above described accident and ensuing injuries to petitioner, Devon Harvey, was proximately caused by the negligence of the defendant, Ray Williams, in the following illustrative, but not necessarily exclusive, acts of negligence;
1. Failure of the driver to maintain proper control of the vehicle;
2. Failure to maintain proper lookout;
3. Failing to yield right of way to oncoming traffic;
4. Operating a vehicle in a careless and reckless manner;
5. Failure to use reasonable vigilance;
6. Failing to obey the traffic laws of the Parish of West Baton Rouge, State of Louisiana, which are pleaded herein by reference;
7. Any and all other acts of negligence which will be proven at the trial of this matter.

VIII.
As the insurance carrier for defendant, Ray Williams, defendant(s) USA Truck Inc., LLC and/or Ace American Insurance, are liable for all damages to petitioner, Devon Harvey, arising out of the negligence of Ray Williams,

As a result of the defendants' negligence enumerated hereinabove, petitioner, Devon Harvey is entitled to reasonable damages, and herewith itemize their damages as follows; Past, present and future physical pain and suffering;
Past, present and future mental pain and suffering; Lost wages; ten (10) days in advance of the date fixed for all Trials or Hearings of any Exception, Motions, Rules or Trials on the Merits, as further provided by L.C.C.P. Articles 1913 and 1914. Furthermore, Devon Harvey, request immediate notice of all Interlocutory and Final Orders and Judgments or Exceptions, Motions, Rules, or the Trial on the Merits in the captioned proceeding."
