"25. The policy issued by Defendant Westchester Fire Insurance Company (WFIC) to Plaintiffs constitutes a contract of insurance.
26. WFIC owed duties to Plaintiffs under the Policy, among others, to investigate, adjust, defend, and indemnify the claims against Plaintiffs in the Lawsuit.
27. All conditions to Plaintiffs' obligations under the contract was fulfilled and/or waived or excused by the words or conduct of WFIC.
28. The actions by WFIC, as described above, constitute breach of the insurance contracts.
29. As a direct and proximate result of WFIC's breach of the insurance contract, Plaintiffs are entitled to damages in an amount to be proved at trial."
