In a lawsuit brought against ACE subsidiary Insurance Co. of North America by Pepsi-Cola Metropolitan Bottling Co. U.S. District Judge Stephen Wilson stated in 2011 that evidence against the insurer established a pattern of delaying payments on valid insurance claims.
VW Tangles with Semi; Now Driver Tangles with ACE Group Unit
December 21st, 2012 - A Louisiana motorist has sued ACE American Insurance Co. over its alleged failure to compensate him for injuries he sustained in an accident with a truck line that was insured by the ACE Group unit.
Devon Harvey, of Orleans Parish, Louisiana, filed suit in district court there against four defendants: ACE American, Ray Williams, USA Truck Inc. and PV Holding Corp. ACE and its client, Van Buren, Arkansas.-based USA Truck, have since petitioned to remove the dispute to U.S. District Court for the Eastern District of Louisiana.
On October. 29, 2011, Devon said that he was driving a 2011 Volkswagen that he had rented from PV Holding (this Virginia Beach, Virginia. firm operates the Avis car rental business). Devon was headed west on Interstate 10 west of Baton Rouge, when he stopped behind a tractor-trailer owned by USA Truck and driven by Williams, when Williams allegedly backed into his vehicle.
Harvey said that the accident injured him, including, but not limited to bones and muscles of his body and nerves and, in particular, his back and neck. He did not say whether he had been treated at a hospital or by a physician.
Harvey said in his lawsuit that Williams was negligent on a number of points, including failure to maintain proper control of his vehicle, failure to yield the right of way and operating a vehicle in a careless and reckless manner.
While the plaintiff not say what specific injuries or damages he had sustained, he did ask the court to award him reasonable damages for pain and suffering and lost wages - past, present and future.
