ACE American, Client Face Lawsuit in Louisiana Federal Court

May 3, 2012 - ACE American Insurance Co. has moved into a federal court with a lawsuit that charges a tractor trailer truck operated by one of its clients injured a carload of people in Louisiana.

ACE and Heartland Express Inc. filed a notice of removal petition in U.S. District Court in New Orleans to move an action to that court that is presently pending against the two companies in district court for the Parish of New Orleans.

The lawsuit originally was filed in March by plaintiffs Darrick Livas Sr., Darrick Livas Jr., Cantrell Livas and Derrick Walker. They had charged the defendants with fault and neglect relative to injuries they reportedly sustained in a May 16th, 2011 collision with a Heartland vehicle operated by Ryan Pahlkotter. Pahlkotter also is named as a defendant.

All of the plaintiffs claim to have sustained internal injuries such as herniated discs, acute muscle strains and other sprains and soft-tissue damage. The said they had sustained medical expenses in the past and anticipated future medical expenses along with hospitalizations and drugs.

Heartland, a national truck line that’s based in North Liberty, Iowa, and Philadelphia-based ACE American both denied any liability and specifically reserved all rights, defenses, objections and affirmative defenses. There was no indication in the legal documents as to what, if any, position ACE American and Heartland may have taken in opposing any claim by the plaintiffs.

The plaintiffs, all from Louisiana, did not specify the exact amount of damages that they seek. But in their removal petition, Heartland and ACE American advised the federal court that it exceeds $75,000, which is the amount required for the action to proceed in federal court.
